OTHER APPELLATE DECISIONS:
D.A.N. Joint Venture v. Binafard, 168 F.3d 498, 1999 U.S. App. Lexis 6733 (9th Cir., 1998).
This business case has a citation but is not an official publication. It involved a creditor lawsuit against the debtor owners of a high-rise building in downtown Los Angeles.
I have also had numerous un-published appellate decisions on numerous subjects, from real estate law to civil procedure, and in particular in the area of HOA law -- ranging from confirming the constitutionality of statutes allowing foreclosure of a unit for failure to pay assessments to the challenge of an election to special issues for associations with age restrictions seeking to comply with senior housing rules to attempts to privatize and gate a community to issues arising from attorney’s fees claims.
